    General terms and conditions of travel arrangements purchase and completion

    Introductory note
    These instructions and terms of travel arrangements booking and purchasing are an integral part of the Contract, that is voucher concluded between Ka travel and passenger/contractual party who signs up for a travel arrangement.

    1. Booking and Contract concluding
    Passenger can sign up for a travel arrangement organized by Ka travel at any Ka travel office, by phone, fax or by other remote communication media, as well as at other authorized agents. By signing the Contract, voucher or application, or giving credit card number when purchasing arrangements by remote communication media, the passenger completely accepts these Terms and Conditions of travel arrangement booking which have previously been carefully studied. During signing up, with the purpose of booking the service chosen, the passenger makes a payment of 30% of the total arrangement price (per person), unless stated otherwise in the programme. Thearrangement has to be paid in full no later than 21 days before the beginning of the trip, unless stated otherwise in the programme (exceptions are made with the installment payments).

    2. Price and arrangement content
    The price of the arrangement (unless stated otherwise in the travel itinerary) usually includes: transfer services, hotel and catering services, and trip organization. If stated in the travel itinerary, the price may include airport taxes and local tour guide expenses. The price of the arrangement does not include (unless agreed otherwise):

    - optional (unobligatory) field trips and visits
    - possible visa issuing expenses
    - entrance fees for facilities visited.

    All kinds of extra services (single room, special diet, etc.) are paid by the passenger and are to be ordered during signing up for the trip. If the passenger asks for extra services during the trip, they are to be paid on the spot to the tour guide or the Agency representative, in the currency of the country one is in.

    3. Price increase right and cancellation right due to price increase
    All arrangement prices are based on the exchange rate of kuna to foreign currencies. Ka travel may demand the confirmed price increase if after Contract conclusion one of the following occurs:

    - exchange rate changes compared to the date of programme release
    - transfer expenses change (fuel, toll, etc.)
    - hotel-keeper and haulier charge rate changes.

    Ka travel may inform the passenger of the price change in writing or orally. The price confirmed can not increase twenty days before the beginning of the trip, except for situations stated in Act 1 of these Terms and Conditions.

    The passenger can cancel the trip without cancellation fees if the price increase is more than 10% of the price agreed, within 48 hours of receiving the written notice. If the passenger does not cancel the trip personally at Ka travel office or in writing within the deadline given, one is considered to be agreeable to the price change. In case of cancellation due to the price increase of more than 10%, the passenger is not entitled to an indemnity. The passenger is obliged to accept the 10% price change. The prices announced are the result of contract between Ka travel and its partners and are not to be correspondent to the prices stated on the spot at a destination where the passenger is staying.

    4. Child discounts and other benefits
    Please pay attention to child discounts and other benefits which are separately stated in the arrangement description.

    5. Travel documentation
    All travel documentation will be delivered not later than 7 days before the departure, unless stated otherwise in the programme. Travel documentation includes:

    1. for the arrangement with personal transfer: original voucher and possible
        written notice
    2. for the arrangement with bus transfer: original voucher and travel itinerary
    3. for the arrangement by plane: original voucher, travel itinerary and plane
        ticket.

    6. Categorization and description of services
    Accommodations offered in Ka travel programmes are described according to the official categorization of a certain country valid at the time of programme issue. Food, modern conveniences and other services offered by the hotel/apartment are under the supervision of local tourist department office, and accommodation and services standards are different and incomparable. Ka travel is not liable for oral or written information which is not in accordance with the description of services and facilities stated in the programmes, and are given by the third party.

    7. Accommodation in rooms/apartments
    Room/apartment arrangement is made by the reception desk at the place of stay. If the passenger has not specifically contracted for a room/apartment of special kind, one will agree upon any officially registered rental accommodation unit in a certain facility described in the catalogue and pricelist. Accommodation in rooms usually is not possible before 4 pm on the day of the beginning of service usage, and rooms usually have to be left before 10 am on the day of the service usage end. Arrivals after 8 pm are to be announced in advance, unless stated otherwise. Pets are allowed in single cases with an obligatory additional payment.

    8. Extra services expenses and offer on inquiry not included in the programmes issued
    If the passenger submits a request for extra services or programmes which are not issued and whose price is not known, one is obliged to pay Ka travel a 10% cash deposit of the total extra service price, or entitles Ka travel to debit the passenger's credit card to the amount of 10% of the total extra service price, as a guarantee fund for such services at the moment of request submission. If the extra service/programme price is not known at the time of inquiry, the passenger is obliged to make an obligatory flat deposit payment of 500,00 kn, or Ka travel will debit the passenger's credit card for the sum given. Ka travel is obliged to inform the passenger of extra services availability no later than 5 working days from the request submission. The passenger is obliged to pay in full the service price within 24 hours of the receival of Ka travel's notice of extra services availability, whereby the deposit paid in cash or by credit card will be included in the service price. If the passenger does not make the payment in the time limit given, Ka travel reserves the right to keep the deposit paid in cash or by credit card. If the passenger is informed within the time limit given of the extra services availability nonexistence, Ka travel is obliged to refund the deposit paid in cash or to cancel the credit card payment within 2 working days of the notice issue.

    9. Cancellation of travel
    If the passenger cancels the arrangement, Ka travel will keep the following amount of the total arrangement price:

    up to 30 days prior to departure 10% of the arrangement price, and at least 100,00 kn
    29 - 22 days prior to departure 30% of the arrangement price
    21 - 15 days prior to departure 40% of the arrangement price
    14 - 8 days prior to departure 80% of the arrangement price
    7 - 0 days prior to departure 100% of the arrangement price
    after departure 100% of the arrangement price

    The cancellation fees stated also apply to the date of departure or accommodation facility changes, that is room/apartment type, as well as to other significant changes. If the passenger who cancels the travel finds a new client for the same reservation, and this client meets all foreseen requirements, Ka travel will only charge the replacement expenses. With all arrangements cancellation, visa(s) and travel documents issuing will not be charged. In case of the passenger's travel cancellation or shortening due to weather conditions, Ka travel will apply the afore-said scale and no delayed complaints will be accepted. With agreeing upon charter travels, incentive travels, cruise travels, language courses abroad, congress and fair travels, long distance travel arrangements and other specific programmes, as well as with programmes during Christmas, New Year's, Easter and other holidays, special terms of travel cancellation fees charge are applied. In case of passenger cancellation, Ka travel reserves the right to charge all expenses arisen, which can make up to the full price of the arrangement, regardless of the cancellation deadlines stated in the Act 9a of these General Terms and Conditions. Special cancellation scale stated in the programme or in the catalogue of these trips is applied to the aforementioned travels. Travel contractual party, that is, Passenger is obliged to comfirm the oral cancellation in writing by mail, fax or e-mail. If the passenger does not confirm the oral cancellation in writing, the trip will not be considered cancelled. If the passenger at one's own request cuts short the ongoing trip, one has no right to a refund of the expenses arisen due to early return to the departure place.

    10. Cancellation risk insurance
    If the passenger at the time of singing up for the trip foresees that the trip might be cancelled due to unpredictable obstacles, in order to avoid cancellation fees stated in Act 9 of these Terms and Conditions, one can pay in cancellation insurance. Cancellation insurance is charged when the Contract is concluded and can not be paid in subsequently. Insurance premium is calculated depending on the trip value, and according to the insurance company pricelist. Every insurance company determines the unpredictable obstacles as a reason for travel cancellation in line with its own terms. In case of arrangement cancellation, the paid-in cancellation insurance premium will not be recouped. With the arrangement cancellation, visa(s) issuing expenses will also not be recouped, even though the passenger has paid in cancellation insurance. If the passenger has not paid in cancellation insurance, and one must cancel the trip due to unpredictable obstacles, Ka travel reserves the right to payment according to the regulations stated in Article 9. Other insurance terms can be found next to insurance policy.

    11. Accident and sickness insurance, luggage damage and loss insurance, and voluntary travel health insurance during travelling and staying abroad
    Prices of the trip do not include accident and sickness risk insurance, luggage damage and loss insurance, or voluntary travel health insurance. By signing the Travel Contract, whose constituent parts are these Terms and Conditions, it is held that passengers have been offered and recommended additional insurances stated in the previous article. If the passenger demands the insurances stated, they can be contracted directly at one of the insurance companies or at Ka travel, in case of which Ka travel is only a mediator. We recommend a careful study of insurance terms before purchase.

    12. Travel cancellation or programme changes made by Ka travel
    If insufficient number of passengers signs up, Ka travel reserves the right to cancel the trip, but no later than 5 days before the beginning of the trip. The minimal number of passengers needed for the trip realization is specified in every programme/arrangement separately. Ka travel reserves the right to completely or partially change the travel itineraries if unusual circumstances which can not be foreseen or avoided occur. Ka travel reserves the right to change the date or time of departure due to flight timetable changes or unpredictable circumstances occurrence, as well as the right to change travel directions if travel conditions change, some of which are: flight timetable change, safety of the country, weather conditions. The changes are free of indemnity charge, and in accordance with the valid international traffic regulations. If Ka travel cancels the trip, the passenger has the right to a complete refund of the amount paid in, but not to a indemnity refund.

    13. Personal travel documents
    Passengers are obliged to own valid travel documents. Invalid travel documents, which lead to travel cancellation, have no harmful effect on Ka travel, and if Ka travel suffers additional damage due to that kind of omission, the passenger is obliged to compensate that damage. If loss or stealing of travel documents happens during the trip, new travel document issue expenses will be defrayed by the passenger oneself. Ka travel tour guide will help the passenger in case of the aforementioned situation, but will keep in mind normal proceeding of the programme. If visa is needed for a certain trip, Ka travel can mediate its issuing with an additional payment. Ka travel is not liable to customs, police or any other state officials' decisions which do not allow the passenger to enter a certain country.

    14. Foreign currency and customs regulations
    Passengers are obliged to adhere to foreign currency and customs regulations, as well as to the law and other decree-act regulations of the Republic of Croatia and other passing through countries or countries in which they are staying. In case of inability to continue the travel due to violation of regulations by the passenger, all expenses arisen will be defrayed by the offender oneself.

    15. Health regulations
    Travels to some countries require obligatory vaccinations against some diseases. When travelling to those countries, the passenger is obliged to have vaccination certificates and documents.

    16. Luggage
    Luggage transport by plane is free up to the weight determined by the airline company. The passenger pays the luggage overweight according to the valid airline company pricelist. With bus transfers the passenger can bring 2 pieces of personal luggage. Passengers are obliged to take care of their belongings taken into the bus cabin, and take them with them when leaving the cabin. Otherwise, passengers take full responsibility themselves of stealing, loss or damage of belongings left in the bus cabin without their supervision.

    17. Complaints
    We would like to emphasize that it is in the passenger's interest to write one's complaint in the book of complaints at service provider on the spot, and the provider will try to provide the service contracted or make amends. If not even after the complaint no improvements are made, the passenger is to ask for a receipt which will show that the service has not been provided, or that it has not been provided in the contracted manner. The passenger has to attach the receipt to the written complaint. The passenger is obliged to submit a written complaint within 8 days of the end of the trip. If the passenger files a written complaint after that deadline, Ka travel is not obliged to take that complaint into consideration. For solving complaints on abroad services, the rules of complaint submission with the receipt issuing on the spot and the complaint submission deadline have to be adhered. The organizer is obliged to publish a written settlement to this complaint within 14 days of the complaint receival, and may postpone the settlement deadline for 14 more days due to information compiling. The organizer will solve only the complaints which could not be solved on the spot or during the trip. During the settlement procedure solving, and not more than 14 or 28 days in total after the complaint submission, the passenger irrevocably gives up any other party mediation, the UHPA or any other institution arbitration, as well as passing the information to the press. Within this period of time, the passenger also gives up the right to a lawsuit. The highest sum of complaint compensation can reach the sum of the part of services complained on, and can not encompass already used services or the total price of the arrangement. In case of entering the contract following the ''Fortuna'' method, the passenger has no right to complain about the accommodation. The passenger and Ka travel will try to settle the disputes by agreement, otherwise they will be submitted to the jurisdiction of a court in Karlovac. The governing law will be the Croatian law.

    18. Ka travel liability
    Ka travel is obliged to ensure the service performance, to choose the service provider with the care of a responsible manager, and to take care of the passengers' rights and interests in accordance with the tourism practice. Ka travel is obliged to provide all contracted services for a specific arrangement to the passenger, and to give a response for possible services or part of service nonperformance. Ka travel will perform all obligations stated in its programmes completely and in the manner described (including the ad herence of the place of passenger boarding and disembarkment obligation), except in case of the act of God or circumstance change. If possible, in those cases Ka travel will offer a substitutional solution. Ka travel is not obliged to provide services outside these Terms and Conditions. Ka travel is not liable for possible print errors.

    19. Passenger liability
    The passenger is obliged to adhere to the code of conduct at accommodation facilities (eg., hotels, hostels, apartments, colleges, mansions, private accommodations, etc.) and in means of transportation. The passenger is also obliged not to prevent the progress of the Travel itinerary by one's conduct and not to imperil the rights of other passengers during Ka travel services usage. If Passenger by one's conduct causes damage to the service provider at an accommodation facility or in means of transportation, or prevents regular and undisturbed progress of the Travel itinerary, one is obliged to repair and compensate such damage immediately to the damaged party, in which process one is obliged to cooperate with the provider of those services and Ka travel. If Passenger prevents regular and undisturbed progress of the Travel itinerary, Ka travel, besides the right to a indemnity, has the right to terminate the trip, in which case the trip will be considered terminated on Passenger's request, and Ka travel will not be obliged to defray the expenses of return to the departure point. If in the aforementioned case Passenger is a minor or a child, the parent is obliged to accept the child's return home or to pick up the child at one's own expense.

    20. Passenger transfer conditions in air travel
    Passenger and luggage air transfer conditions are defined by the airline company and Passenger is obliged to adhere to them.

    21. Travel organizer insolvency or bankrupcy insurance
    In accordance with the Act on the provision of tourism services, in case of Ka travel insolvency or bankrupcy, passengers travelling at that time, as well as the ones who have paid in travel deposit, should contact the insurance company stated in the Travel Contract or in other suitable document as soon as possible.

    22. Liability insurance
    In consistence with the Act on the provision of tourism services, Ka travel and the insurance company have concluded a contract on liability insurance for the damage caused to the passenger by nonfulfillment, partial fulfillment or improper fulfillment of obligations considering the package arrangement.

    23. Personal data protection
    The passenger gives one's personal data voluntarily. Passengers' personal data are needed in the process of the requested service realization. The data will also be used for future correspondence. Ka travel is obliged not to take the passengers' personal data out of the country or give them to the third party, except for the purpose of the requested service realization. An exception to giving the personal data to the third party refers to contracting the cancellation risk insurance, accident and sickness insurance, luggage damage and loss insurance, and voluntary travel health insurance during travelling and staying abroad. If the passenger concludes the insurance policy, personal data will be forwarded to the insurance company. Passenger's personal data will be saved in a database, in accordance with the Board decision on the way of acquiring, processing and keeping personal data. The passenger allows usage of one's personal data for the purpose of Ka travel marketing.

    CLOSING PROVISIONS
    These General Terms of travel are an integral part of the Contract which the passenger concludes with Ka travel, that is with an authorized travel agency at which one has signed up for the trip organized by Ka travel. Possible/foreseen divergences from these Terms and Conditions are to be stated along with the travel itinerary text if tour operators - foreign travel organizers - are involved. By signing the contract, the passenger completely accepts the programme and terms of travel. This edition of travel terms excludes all previous editions.
